Restaurant License and Alcohol License
In Thailand, obtaining a food and beverage license for a restaurant is essential for serving food and drinks. To secure this license, you must first register your business with the Department of Business Development (DBD) and then apply to the local health department or relevant authority. The application process typically requires documentation such as your business registration, proof of premises, and sometimes a menu. Your restaurant will also need to pass health and safety inspections before the license is granted. It’s important to stay informed about local regulations, as requirements can vary by location, and be prepared for periodic renewals and associated fees.
Import and Export License
In Thailand, an import and export company must obtain specific licenses based on the category of goods being traded. Controlled items, such as food, medicines, and cosmetics, require additional licenses from the Food and Drug Administration, while electronic devices like mobile phones need permits from the National Broadcasting Department. Generally, businesses must apply for a customs paperless license from the Customs Department to operate under their company name. Failure to obtain the necessary licenses can hinder import and export activities. The government regulates these licenses to protect local industries and public health. Although the licensing process can be complex, with the right resources and local expertise, businesses can navigate it effectively to engage in international trade.
Travel Agency License
To start a travel agency in Thailand, obtaining a Tourism License from the Tourism Authority of Thailand (TAT) is essential before offering any tour or travel packages. This license is necessary for engaging in tourism activities, such as organizing tours and booking accommodations, and is divided into categories for inbound, outbound, and domestic tourism. Companies must have majority Thai ownership and appoint a local director who can sign for the license, with their authority limited to tourism-related matters. A limited company must have at least 51% of its capital owned by Thai nationals, and at least half of its directors must also be Thai. Foreigners interested in entering the tourism sector must incorporate a juristic entity to apply for the TAT license, as tourism activities are restricted under the Foreign Business Act.
Education License
Starting an education business in Thailand involves obtaining the necessary licenses and approvals from either the Ministry of Education or the Department of Social Welfare, depending on the type of educational services offered. The initial step is to establish your business, with a Thai company structure often being the most efficient choice for quick registration.
In addition to licensing, it’s important to comply with local regulations regarding facilities and educational standards. This might include ensuring that your premises meet safety and accessibility requirements, as well as aligning your curriculum with national educational guidelines.
Recruitment License
To establish a recruitment business in Thailand, a license from the Department of Employment is mandatory, with companies unable to operate both domestic and outbound recruitment simultaneously. The board must have a majority of Thai directors, who are authorized to sign recruitment documents, along with a majority of Thai shareholders. The office needs to be a minimum of 16 square meters, clearly identified with the company name, and legally authorized for recruitment use—virtual offices are generally not acceptable. A security fee must be paid during the application process to demonstrate financial capacity for any potential compliance penalties. After obtaining the license, the company name must include terms like “Recruitment” or “Manpower,” and the license remains valid for two years.
